Welcome to StayHub. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and StayHub. We reserve the right to modify these Terms at any time, and your continued use of the platform constitutes acceptance of any changes.

2. Definitions

  • "Platform" refers to the StayHub website, mobile applications, and services
  • "User" refers to anyone who accesses or uses the Platform
  • "Host" refers to a User who lists a property on our hotel booking and listing platform
  • "Guest" refers to a User who books accommodation through the Platform
  • "Listing" refers to a property advertised on our hotel booking and listing platform
  • "Booking" refers to a reservation made through the Platform

3. Eligibility

To use StayHub, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations

4. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree to:

  • Provide accurate, current, and complete information
  • Update your information to maintain its accuracy
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with others
  • Be responsible for all activities under your account

5. Host Responsibilities

As a Host, you agree to:

  • Provide accurate and complete Listing information
  • Honor confirmed Bookings and availability calendars
  • Comply with all applicable laws, including tax obligations
  • Maintain your property in a safe and habitable condition
  • Respond promptly to Guest inquiries and concerns
  • Provide the amenities and services described in your Listing
  • Not discriminate against Guests based on protected characteristics
  • Obtain necessary permits, licenses, and insurance

6. Guest Responsibilities

As a Guest, you agree to:

  • Provide accurate booking information and payment details
  • Treat the property with respect and follow house rules
  • Leave the property in the condition you found it
  • Comply with maximum occupancy limits
  • Report any issues or damages promptly
  • Not engage in illegal activities on the property
  • Respect neighbors and maintain reasonable noise levels

7. Bookings and Payments

7.1 Booking Process

When you make a Booking, you enter into a contract directly with the Host. StayHub acts as a limited agent for the Host for payment collection purposes.

7.2 Pricing and Fees

Hosts set their own pricing. The total cost includes the nightly rate, cleaning fees, service fees, and applicable taxes. All fees are clearly displayed before booking confirmation.

7.3 Payment

Payments are processed through secure third-party payment processors. Guest payments are held by StayHub and released to Hosts according to our payment schedule (typically 24 hours after check-in).

7.4 Service Fees

StayHub charges a service fee for using the Platform. Guest service fees typically range from 10-15% of the booking subtotal. Host service fees are typically 3% per booking.

8. Cancellation and Refund Policy

8.1 Guest Cancellations

Refund eligibility depends on the cancellation policy chosen by the Host:

  • Flexible: Full refund if cancelled 24 hours before check-in
  • Moderate: Full refund if cancelled 5 days before check-in
  • Strict: 50% refund if cancelled 7 days before check-in

8.2 Host Cancellations

Host cancellations are strongly discouraged and may result in penalties, including cancellation fees, calendar blocking, and account suspension. Guests receive full refunds for Host-initiated cancellations.

9. Prohibited Activities

You may not:

  • Violate any laws, regulations, or third-party rights
  • Post false, misleading, or fraudulent content
  • Engage in discriminatory practices
  • Circumvent service fees by completing transactions off-platform
  • Use the Platform for unauthorized commercial purposes
  • Harass, abuse, or harm other Users
  • Upload viruses or malicious code
  • Scrape or copy content without permission
  • Impersonate others or create fake accounts

10. Content and Intellectual Property

10.1 User Content

You retain ownership of content you post on StayHub. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform.

10.2 Platform Content

All content on the Platform, including text, graphics, logos, and software, is the property of StayHub or its licensors and is protected by copyright and trademark laws.

11. Disclaimers and Limitations

11.1 No Endorsement

StayHub does not endorse, warrant, or guarantee any Listings, Hosts, Guests, or third-party services. We are not responsible for the conduct of Users or the condition of properties.

11.2 Limitation of Liability

To the maximum extent permitted by law, StayHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11.3 Insurance

Hosts and Guests are responsible for obtaining appropriate insurance coverage. StayHub does not provide insurance and is not an insurer.

12. Dispute Resolution

If a dispute arises between Users, we encourage resolution through our customer support team. If we cannot resolve the dispute, it may be submitted to binding arbitration in accordance with applicable laws.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our discretion. You may close your account at any time through your account settings.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which StayHub is registered, without regard to conflict of law principles.
